Terms and Conditions

ARTICLE 1.

The present General Terms and Conditions of Sale (GTCS) govern the terms and conditions for the rental of classic vehicles offered by Cap Méhari (hereinafter referred to as “the Renter”). Any reservation implies unreserved acceptance of these GSC by the customer (hereafter “the Hirer”).

ARTICLE 2.

The vehicles offered for rental are classic and/or exceptional cars, regularly maintained and inspected. They are rented in good working order and cleanliness, and the Hirer guarantees their compliance with current safety standards.

ARTICLE 3.

The driver undertakes to provide a valid European driving license and proof of current address. The driver must be over 23 years of age and have held his or her license for more than 5 years. The same applies to any additional driver duly mentioned on the contract. The driver undertakes to comply scrupulously with the Highway Code. Any contravention occurring during the rental contract period will be the responsibility of the driver, who will assume all consequences and will not hold Cap Mehari responsible in any way whatsoever. In the case of a driver who does not reside in France, or who holds a non-French European driving license, the security deposit will be retained by Cap MéharI for one month after the end of the rental period, in order to cover the cost of any fines incurred during the rental period and which the renter did not pay immediately or failed to notify Cap Méhari of upon return of the vehicle.The driver also undertakes not to leave French territory, sublet the vehicle, transport dangerous or flammable substances, exceed the maximum permissible laden weight, exceed the number of 4 occupants per vehicle, or have the vehicle driven by a driver not declared to Cap Méhari. The vehicles are equipped with GPS tracers. All vehicle movements and stops are recorded (directive 2002/58/CE-CNIL).

ARTICLE 4

Security deposit: The security deposit is set at €1,500, payable by bank transfer on the day the Mehari is collected. The hirer undertakes to return the vehicle in the condition in which it was delivered. A check of the general condition of the vehicle and an inventory of the equipment on board will be carried out and signed off by both parties. Any missing equipment will be invoiced and deducted from the security deposit. If the hirer does not wish to carry out an inspection on departure, the vehicle will be deemed to be in perfect condition and all accessories will be returned. Any damage, in particular to parts not covered by insurance and not resulting from a traffic accident not at fault, is the direct responsibility of the hirer (see additional costs table). The resulting costs will be covered by the security deposit. However, if these costs exceed the amount of the security deposit, the lessee undertakes to reimburse the full amount, failing which Cap Mehari reserves the right to take any legal action necessary to recover the sums incurred for the repair of the vehicle. Any damage to the tires, including punctures, will be repaired entirely at the hirer’s expense, leaving him/her free to choose the repairer. The soft top and its structure are removable. An explanation of how to handle it will be provided if necessary. In the event of damage to the headlights, mirrors and windscreen, repairs must be paid for in full by the hirer, who has a choice of repairer.

ARTICLE 5

The rental is effective as soon as the contract is signed. The non-use of the vehicle by the renter during the contract period, for any reason other than a mechanical breakdown unrelated to the improper use of the vehicle, in particular driving off tarmac roads, does not entitle the renter to a refund.The driver also undertakes not to drive on roads not authorized for traffic, whether marked or not, and any immobilization of the vehicle resulting from a misjudgment of the driving conditions (in particular silting up) may result in the immediate cancellation of the rental contract without reimbursement by the rental company, and will also have to assume all costs necessary to get the vehicle back on the road and in good condition. Before each departure, the declared driver(s) must familiarize himself/herself with the operating instructions and driving specifications, and must demonstrate his/her/their ability to drive safely; if the rental company considers that a driver is unable to meet the criteria for safe and responsible driving, it reserves the right to remove him/her/them from the list of authorized drivers, or even to cancel the rental. In this case, 50% of the rental charge will be retained.

ARTICLE 6

Reservations can be made online, subject to vehicle availability. By internet, payment of the full rental amount will be required. All orders placed on the website https://www.capméhari.fr are subject exclusively and without reservation to the present general rental conditions valid on the date of the order and in force on the website. Rental prices are quoted in euros and may vary according to vehicle model and rental period.

ARTICLE 7

• Condition of the vehicle: A detailed inventory is carried out before and after the rental period. Any damage not mentioned in the initial inventory will be charged to the Hirer.
• Pick-up and drop-off locations: Pick-up and drop-off locations and times are agreed at the time of booking. Any delay in return may result in additional charges.
• Mileage: Rental includes 200 kms per day
• Charges for mileage, fuel, cleaning or other additional services may be applied in the event of failure to return the vehicle fully fuelled, dirty or if the mileage is exceeded (see additional cost table).

ARTICLE 8

The Hirer undertakes to use the vehicle with care and under normal conditions. It is strictly forbidden to :

• Use the vehicle for races, competitions or other sporting events;
• Allow unauthorized third parties to drive the vehicle;
• Operating the vehicle under the influence of alcohol, drugs or medication.

ARTICLE 9

Cancellation: Insofar as orders are firm and are taken into account for the organization of Cap Mehari’s activities, any cancellation by the hirer will be subject to deduction by the rental company of a cancellation indemnity, the amount of which will depend on the date on which the cancellation occurs. For any cancellation within :

• Less than 30 calendar days before the rental date: refund of 90% of the rental price.
• Between 29 calendar days and 3 calendar days before the rental date: refund of 50% of the price paid.
• Less than 2 calendar days before rental date: no refund.

Reservation changes (dates, vehicle model) are subject to availability and may incur additional charges.

ARTICLE 10

The Hirer cannot be held responsible for any delay or failure to complete the rental in the event of force majeure (accident, major breakdown, natural disaster, etc.). In such cases, the reservation may be cancelled or postponed free of charge. Safety: The rear seats are not equipped with seatbelts. It is the responsibility of the driver, who is responsible for the safety of the passengers, to drive in such a way as not to endanger the occupants of the rear seats and to ensure their safety. Furthermore, acceptance of the present conditions of sale implies that in the event of bodily injury to rear-seat passengers, whether or not as a result of an at-fault accident, Cap MEHARI may not be held liable in any way for such damage, and may not be sued for this reason.

ARTICLE 11

The fact that the hirer ticks the box “I have read the general terms and conditions of sale and I accept them” before validating his/her order automatically implies his/her acceptance of the present general terms and conditions of sale without restriction or reservation. The hirer hereby acknowledges that he/she has read and understood the present terms and conditions of sale and accepts them. Booking confirmations will be sent by e-mail to the hirer at the address indicated in the order. The hirer is reminded that the order is firm and final and that he/she has no right of withdrawal (article L121-20-4 2° of the French Consumer Code).
