Any additional driver must meet the same requirements and be specifically named in the contract. If the vehicle is driven by an unauthorized third party, insurance coverage will be void and the Renter will be personally liable. <\/p>\n
Art. 3 \u2014 Obligations of the Lessor<\/h2>\n
The Lessor agrees to:<\/p>\n
- \n
- provide a vehicle in good working order that complies with the contractual description and is accompanied by its registration certificate and insurance certificate;<\/li>\n
- provide the Tenant, prior to move-in, with a copy of this lease agreement and the schedule of additional costs;<\/li>\n
- have taken out liability insurance in accordance with Articles L. 211-1 et seq. of the Insurance Code, the cost of which is included in the listed price;<\/li>\n
- inform the Renter of the vehicle\u2019s specific features (e.g., vintage vehicle, seat belts, maximum speed) before handing over the keys.<\/li>\n<\/ul>\n
Art. 4 \u2014 Tenant\u2019s Obligations<\/h2>\n
The Tenant agrees to:<\/p>\n
- \n
- use the vehicle in accordance with its intended purpose and the rules of the Highway Code;<\/li>\n
- Do not sublet or lend the vehicle to an unauthorized third party;<\/li>\n
- do not participate in competitions, races, or test runs;<\/li>\n
- Do not drive outside of public roads or on terrain unsuitable for normal vehicle use (beaches, dunes, sandy paths, unauthorized private property, etc.)<\/li>\n
- Do not transport hazardous, flammable, or explosive materials, or any materials that could damage the vehicle or endanger its occupants;<\/li>\n
- do not leave the continental United States without the Lessor\u2019s prior written authorization;<\/li>\n
- Do not drive while under the influence of alcohol (blood alcohol concentration \u2265 0.5 g\/L) or drugs;<\/li>\n
- immediately report any breakdown, damage, or accident to the Lessor;<\/li>\n
- return the vehicle on the agreed date, at the agreed time, and at the agreed location, in the same condition as when it was delivered to the renter.<\/li>\n
- pay all costs associated with repairs, towing, removing the vehicle from sand, or recovering the vehicle resulting from use that does not comply with these terms and conditions;<\/li>\n<\/ul>\n
In the event of an accident, the Renter must complete an accident report form, submit it to the Rental Company within 24 hours, and not admit liability without the insurer\u2019s consent.<\/p>\n
Art. 5 \u2014 Rates and Payment<\/h2>\n
The applicable rate is the one listed at the time of reservation. Any day that has begun is charged in full. Prices include all taxes. The mileage included in the rental is specified in the special terms and conditions or on the reservation form. Any mileage exceeding the included allowance will result in additional charges based on the rates listed in the schedule of additional costs. In the event of non-payment, late payment interest at the statutory rate plus five percentage points will be automatically due as of the date of the formal notice. <\/p>\n
A reservation is considered final only after payment has been received. Weather conditions\u2014even unfavorable ones\u2014do not constitute grounds for cancellation or a refund. <\/p>\n
When the contract is concluded remotely (online or by phone), the Renter is informed that, in accordance with Article L. 221-28, 12\u00b0 of the French Consumer Code, they have no legal right of withdrawal if the rental concerns a vehicle scheduled to be made available at a specific date and time.<\/p>\n
Commercial Cancellation Policy<\/u>: On a commercial basis, without acknowledging any legal right of withdrawal, the Lessor agrees to the following terms:<\/p>\n
- \n
- Cancellation more than 30 calendar days before departure: full refund of the deposit;<\/li>\n
- Cancellation between 29 and 7 calendar days before departure: 50% of the deposit paid will be retained;<\/li>\n
- Cancellation less than 7 calendar days before departure or no-show: the full rental price is due.<\/li>\n<\/ul>\n
In the event of duly documented force majeure (hospitalization, death of a first-degree relative), the Lessor will consider the request for a refund on an exceptional basis and without any guarantee of approval.<\/p>\n
Section 6 \u2014 Term and Return<\/h2>\n
The rental period ends at the agreed date and time. Any extension must be expressly granted by the Lessor in writing prior to the expiration of the initial term; it is subject to availability. Any unauthorized delay in returning the vehicle will result in a flat penalty of \u20ac10 per hour or portion thereof, capped at the current daily rate per 24-hour period. After 4 hours of unjustified delay, the Lessor reserves the right to charge for an additional day at the standard rate. <\/p>\n
The Tenant is informed of these penalties prior to the conclusion of the contract, and they are automatically due without prior notice.<\/p>\n
Art. 7 \u2014 Insurance<\/h2>\n
The Lessor has taken out a mandatory civil liability insurance policy (Art. L. 211-1 of the Insurance Code) covering bodily injury and property damage caused to third parties, as well as damage to passengers. Insurance coverage is automatically suspended in the event of non-compliance with the terms of this article and Articles 2 and 4 (unauthorized driver, driving under the influence of alcohol, improper use, etc.). <\/p>\n
Art. 8 \u2014 Security Deposit (Deposit)<\/h2>\n
A security deposit of \u20ac1,500 is required before the keys are handed over, in the form of a non-cashed check or a bank pre-authorization. It will be refunded within 5 business days of the vehicle\u2019s return. Any partial or total deduction is subject to the Lessee\u2019s prior receipt of written proof of the alleged damage (a professional estimate or a paid invoice), sent by email or certified mail within the same 5-business-day period. If no proof is provided within this timeframe, the security deposit is refunded in full. For damages not covered by the schedule, the assessment is conducted by an expert, with costs advanced by the Lessor. The withholding of all or part of the security deposit results in a detailed invoice. <\/p>\n
Art. 9 \u2014 Tenant’s Liability and Fee Schedule<\/h2>\n
The Renter is liable for all damage to the vehicle that occurs during the rental period, including damage not covered by or excluded from the insurance coverage. The applicable flat rates are listed in the schedule of additional costs. These flat rates constitute a maximum limit in cases of partial coverage and a standard assessment of direct damages. Any additional compensation beyond the flat rates is subject to proof of actual and direct damages exceeding the applicable flat rate, upon presentation of an estimate or invoice issued by a professional. Non-Cumulative Coverage: Vehicle downtime costs and late return penalties do not accumulate for the same incident. <\/p>\n
Art. 10 \u2014 Traffic Violations<\/h2>\n
The Renter is solely responsible for any traffic violations committed during the rental period, regardless of their nature (speeding, parking violations, cell phone use, etc.). In accordance with Article L. 121-6 of the Highway Code, the Lessor is required to identify the driver responsible for a violation detected by law enforcement or by an automated enforcement system. By signing this contract, the Renter expressly consents to this designation and authorizes the Rental Company to disclose their contact information (last name, first name, address, driver\u2019s license number) to the National Agency for the Automated Processing of Traffic Violations (ANTAI), within the limits set by the GDPR and the recommendations of the CNIL. The amount of any traffic ticket forwarded to the Lessor will be billed to the Lessee, plus a \u20ac10 administrative fee per violation (see schedule of additional costs), payable within 15 days of notification. <\/p>\n
Art. 11 \u2014 Protection of Personal Data (GDPR)<\/h2>\n
CAP M\u00c9HARI is the data controller responsible for processing the Renter\u2019s personal data within the meaning of Regulation (EU) 2016\/679 (GDPR) and Law No. 78-17 of January 6, 1978, as amended. The data collected (identity, contact information, driver\u2019s license number, payment details) is processed for: the performance of the contract (legal basis: contractual performance); the management of claims and disputes (legal basis: legitimate interest); registration of the driver with ANTAI (legal basis: legal obligation). Retention periods: contractual data retained for 5 years from the end of the rental; data relating to traffic violations retained for 45 days in the active database and then for 12 months in intermediate storage. Geolocation: if the vehicle is equipped with a geolocation device, the Renter is expressly informed of this before the keys are handed over. This device is activated solely for the purposes of theft prevention and emergency geolocation; no continuous monitoring is carried out during the rental, in accordance with the recommendations of the CNIL. Location data is retained only in the event of a duly recorded incident. Renter\u2019s Rights: In accordance with Articles 15 through 22 of the GDPR, the Renter has the right to access, rectify, object to, erase, and request data portability, which may be exercised in writing at the Lessor\u2019s address or via email. In the absence of a satisfactory response, the Renter may file a complaint with the CNIL (www.cnil.fr). No personal data is transferred to third parties for commercial purposes. <\/p>\n
Art. 12 \u2014 Unfair Terms and Consumer Law<\/h2>\n
This contract is subject to the provisions of the Consumer Code. Any clause that creates a significant imbalance to the detriment of the consumer-lessee is deemed null and void (Art. L. 212-1 of the Consumer Code). Recommendation No. 96-02 of the Commission on Unfair Terms relating to vehicle rentals has been taken into account in the drafting of this contract. <\/p>\n
Section 13 \u2014 Termination<\/h2>\n
In the event of a serious breach by the Renter of his or her obligations (driving under the influence of alcohol, improper use, non-payment), the Lessor may terminate the contract automatically and without delay, repossess the vehicle, and invoice the Renter for any outstanding amounts as well as collection costs.<\/p>\n
Art. 14 \u2014 Disputes and Competent Jurisdiction<\/h2>\n
In the event of a dispute regarding the formation, interpretation, or performance of this contract, the parties agree to seek an amicable resolution within 30 days of a written complaint being submitted to the Lessor. In the absence of a satisfactory response, the Tenant, as a consumer, may file a complaint free of charge with the CM2C consumer mediator (Center for Consumer Mediation and Judicial Conciliation) at 14 Rue Saint-Jean, Paris, in accordance with Articles L. 612-1 et seq. of the Consumer Code. In the event of legal action, if the Renter is acting as a consumer, they may, at their discretion, bring the matter before the court of the place where they resided at the time the contract was concluded or the place where the harmful event occurred, in accordance with Article R. 631-3 of the Consumer Code. If both parties are acting in a professional capacity, the competent courts are those of the place where the vehicle was delivered. This contract is governed exclusively by French law. <\/p>\n
